Comments
: FSPA has been working with the Building Officials Association
of Florida and the United Pool & Spa Association to put forward language
that will resolve issues related to proposed changes to 64E-9, the public
pool rule. Specifically, language would clearly provide that the Department of
Health has the ability to inspect existing public pools for items that fall under
the building code and that are considered construction items during their
biennial inspections. FSPA, in conjunction with BOAF and UPSA, have been
discussing this issue with DOH, the Governor’s office, and legislators in order
to ensure both citizens and tourists are protected and we look forward to a
positive resolution. This legislation is the result of these efforts. Effective Date:
July 1, 2015

:
These bills as currently drafted may be problematic in that
1) the FL Department of Health may not have the funding to have properly
trained people to inspect public pools for electrical aspects, 2) the disclosure
statement does not look at all aspects of electrical wiring of the property, and
3) some aspects addressed in this bill are already required via the Florida
Building Commission’s adoption of the National Electrical Code. However,
FSPA looks forward to working with the bill sponsors to work out these kinks
and wants to always ensure proper safety mechanisms are in place.
